Omnibus is a consumer-protection rule that has applied in Poland since 1 January 2023 and comes from the EU Omnibus directive. Whenever you show customers a discount, you must show the lowest price from the 30 days before that discount next to the reduced price.
The rule also covers digital products: ebooks, courses, templates, consultations and subscriptions. What counts is the price at which the product was offered, even if nobody bought it at that price.
When you need to think about it
- You show a crossed-out price, for example
PLN 299PLN 199. - You write “-30%”, “Black Friday: PLN 100 off” or “sale”.
- You advertise a discount together with a price in an email, on Instagram, on a web page or in an ad. The lowest price from the last 30 days must be there too.
What else to watch out for
- The discount percentage is calculated from the lowest price of the last 30 days, not from the “regular price”.
- If the product has been on sale for less than 30 days, you show the lowest price since the day sales started.
- The information must be right next to the reduced price and easy to read. Do not hide it in a footnote or a tooltip.
Why it matters: penalties
- Trade Inspection (Inspekcja Handlowa): up to PLN 20,000, and up to PLN 40,000 if the violation is repeated at least 3 times within 12 months (Act on price information, art. 6).
- UOKiK (the consumer protection authority): if the practice harms the collective interests of consumers, up to 10% of annual turnover, and up to PLN 2 million for the person managing the business.
- UOKiK really does check this. Zalando received a fine of nearly PLN 31 million and Temu almost PLN 6 million (UOKiK announcement on the fines for Zalando and Temu).
A “sale” where the price was never higher before is simply misleading customers. Inspections and complaints are most common before Black Friday.
